Domain Names and Trade Marks – Be Warned!

Domain names can make or break your business, and great care should be taken when choosing a name. When I first started internet marketing, I was very naive and didn’t know what to do. I believed everything someone told me. After all, these were the experts – right?

I paid a lot of money for a tutorial block that basically consisted of a few half hour phone calls at very inconvenient times where a so called “expert” told me to go and do certain things. However, he didn’t tell me how to make them or where to start.

When I have problems, I had to ask questions, but since everything was a problem, I didn’t know where to start. Also, since I had paid for a fixed amount of time, I needed to get as much guidance as possible, even if I had no idea how to implement it.

In the end, I spent a lot of money and achieved nothing. I wasted a lot of time and made a LOT of mistakes. It would have been easy to throw in the towel, but there is a saying – “When the student is ready, the teacher will come” and luckily I have now found a mentor who not only talks, but also shows what to do.

Now I’d like to give you some advice about something you may not have thought about. I wasn’t until recently.

If you want a web presence, you need a domain name, and there are many places to buy one. However, you need to be careful when choosing a URL. Just because it’s available doesn’t necessarily make it safe to use.

Here is my story.

More recently, I ran a blog about weight loss. This is a topic that affects many and especially women going through menopause.

The site was up for several months, and while I didn’t post often, I was proud of my efforts and the others who linked to it. It wasn’t specifically about dieting, but rather the need for healthy eating and exercise.

Anyway, based on the theme, I chose a good domain name in my opinion. Unfortunately, the two consecutive words formed the name of a well-known slimming club, and although I had never mentioned the company in my posts or meta tags, several months later I received a letter from a trademark law firm advising me. I had to stop using this site immediately. I had to transfer the domain name to their clients or risk legal action.

The company didn’t seem to have any objections to my blog or its content, in fact they liked it, BUT they were concerned that I was ruining their reputation. I offered to put out a statement on the site stating that I had no links to them and advised anyone who actually wanted to go to a slimming club to check them out. Their program is good (if you follow it) and once I even wrote a poem about them.

They refused, and I think I can understand that. Although using their company in my domain name was completely unintentional, I quit checking the site because you don’t mess with their lawyers.

My point is that you have to check!

Some people (including my mentor) recommend putting your success on the backburner, but not everyone is so conscientious.

The problem is that when you buy a domain name, you don’t know if you will be objected. Many companies will sell you domain names when they’re not already taken, but they don’t know (or care) whether some of the names are trademarked or not, or what categories they’re listed in. It’s up to you to check.

Obviously, you’re safe to use your name, but don’t use words made up of brands or company names in sequence, especially if you’re marketing in the same type of niche. I did this by accident and it was a real headache to get everything right.

Probably, if I had been involved in something completely different: health, weight loss, fitness, etc., i.e. internet marketing, the blog might still exist, but the company had registered its name in several countries in several categories, that was their wish. to brand yourself.

It’s just something to consider, and if you’re worried about others rejecting your hard work, consider branding your specific name or product yourself!
